Do we have grounds for a lawsuit involving an accident-the-job with a defective piece of machinery?
My husband was injured at work the week 2, which requires immediate medical attention and surgery. He was about to lose his whole hand in an accident of meat grinder. The mill is assumed that has a safety mechanism, in which if lifted the lid, the machine cut, but not working. I guess that is to receive workers comp. benefits, but this is a malfunctioning safety grounds for a lawsuit? It seems that the hand will never be fully functional. I fear that his career as a meat cutter is over. He did not have any other business to do and their age is a factor (58). I fear it will be unable to work enough after the accident.
I think you have one helluva event! This is an OSHA requirement that All Machines in the workplace are inspected and in working condition. Obviously, this was not making it no doubt the guilt of their employers. And I disagree that you do not have a case if her husband knew security was not working. It remains the responsibility of employers have this set to avoid exactly what happened to her husband happen to anyone. And I think you have a case even better, because as far as he knew that security was not work. I can not imagine that you have trouble getting a lawyer to take this and why in the world is not going to win. You must now apply for disability, because it can take up a year for this to be passed (or more). You may not be able to work again and if they can not work, therefore no income coming in, you will be hurt by money. The demand to take a long time and most likely so will the disability. Start working in the two immediately.
